Right of Way Agents perform specialized technical duties associated with acquisitions of rights of way for construction, operation and maintenance of water supply facilities. Incumbents may also coordinate the disposition of surplus property and assist in the maintenance/management of real property interests acquired. Incumbent deals with property owners, public agency staff and the public in explaining right of way activities and may negotiate terms and compensation for acquisition or sale. Work entails the use of independent judgment and the application of knowledge gained through education, professional training and experience regarding real estate titles, property appraisal and the acquisition or sale of property and easements.
Acquires permits for the use of federal lands, coordinating compliance with all environmental requirements.
Obtains appraisal and preliminary title reports prepared by independent appraisers and title companies to determine present and future value of property affected by proposed facilities; makes recommendations regarding appraised value for purchase or acquisition of easements and fee title.
Conducts negotiations with property owners for the acquisition of rights of way, easements, construction easements, and other interests in real property for District/SNWA pipelines, facilities and appurtenances; prepares and reviews legal descriptions, easement documents, deeds and other documents associated with property acquisition or sale; prepares agenda items for Board approval of land purchases, sales and right of way acquisitions.
Assists with the condemnation process where necessary; prepares legal documents for inclusion in condemnation packages submitted to court; attend settlement conferences to convey settlement offers.
Conducts or directs the recordation of legal documents for property purchase or sale and easement acquisitions; prepares and maintains records of property purchase or sale and acquisition easements for right of way.
Assists in preparing reports for weekly construction project status meetings and reports on the status of right of way acquisition.
Excellent organizational and planning skill
Ability to plot metes and bounds descriptions of property and read a variety of maps, electronic and paper
Ability to read and analyze engineering drawings and right of way plans in order to properly explain the taking.
Demonstrated skills in verbal/written communications
Demonstrated negotiating and decision making skill
High commitment to achieving goals and plans
The ability to read, understand and communicate property valuation information to landowners, as contained in formal real estate appraisals prepared by professional state certified appraisers
The ability to render independent land value judgments and determine when compensation beyond the value outlined in an appraisal is justified.
Proficient in programs necessary to maintain documentation and produce reports.
Understands technology of projects well enough to explain and discuss with property owners
Skilled in variety of research methods, particularly internet, courthouse and recorded documents
Knowledge of how to determine valuations of crops, trees, pastures, etc for damage settlement
